Duke Energy Carolina’s
Performance-Based Regulation Application

Session Law 2021-165 authorizes performance-based regulation for electric public utilities and directs the Commission to adopt implementation rules, which it did on February 10, 2022. (See the Commission’s order issued February 10, 2022, in Docket No. E-100 Sub 178.)

On September 8, 2022, Duke Energy Carolinas, LLC (DEC) filed with the Commission a letter stating that the Company intends to file a general rate application that will include performance-based regulation. DEC requested that the Commission initiate a technical conference regarding the transmission and distribution projects that DEC intends to include in its performance-based regulation application. In addition to scheduling this technical conference, the Commission ordered DEC to file information on those transmission and distribution projects in Docket No. E-7 Sub 1276 no later than October 19, 2022.

There will not be an opportunity for members of the public to speak at the technical conference. Comments on DEC’s plans for including transmission and distribution projects in its performance-based regulation application can be sent to the Commission at the address below or emailed to the Commission here. Please include the docket number (E-7 Sub 1297) in the subject line. After two or three business days, written comments become part of the official record and can be viewed via this website under the docket number.
